The cosmetic regulation
Regulation (EC) 1223/2009 on cosmetic products came into effect on July 11, 2013, throughout Europe. It is referred to as the "cosmetic regulation." One of the pillars of this new cosmetic regulation is compliance with Good Manufacturing Practices (GMP). The corresponding article states:
" Article 8: Good Manufacturing Practices.
1. The manufacturing of cosmetic products complies with good manufacturing practices to ensure the objectives of Article 1.
2. Compliance with Good Manufacturing Practices is presumed when manufacturing is carried out in accordance with the applicable harmonized standards whose references have been published in the Official Journal of the European Union."
Therefore, since July 2013, all cosmetic products circulating in the European market must be developed in compliance with GMP, as described by the ISO 22716 standard.
The declaration of conformity
The responsible person must attest to compliance with the Good Manufacturing Practices referred to in Article 8 of the cosmetic regulation. This declaration of conformity can be made by themselves or by a third party and must be included in each PIF of each cosmetic product.

Certification* by a third party has a significant commercial impact. Indeed, it allows, through its obtaining, to prove that the company operates according to the Good Cosmetic Practices in the eyes of clients and international authorities.
As of March 1, 2025, the certification* ISO 22716 issued by a third-party certification body, such as ATeCQ Certification, allows for the initiation of administrative procedures with the French administrative authority for the purpose of exporting to countries outside the European Union.
*Only the competent authority is authorized to verify the ability of production sites to manufacture cosmetic products and issue an official certificate recognized internationally. In France, it is the DGCCRF that is responsible for conducting inspections and issuing official certificates in accordance with French decree 2024-1250 and the order of February 20, 2025.

Once the audit is completed, expect an average of 2 months to obtain the certificate. The timeline also depends on your responsiveness to implement the requested actions and to have them validated by the auditor.
There is no surveillance audit, but there is a systematic annual full audit. We believe there are too many possible variations from one year to the next, particularly regulatory, to only conduct a partial audit.
The certificate is valid for one year from its date of issuance. You will be contacted in advance to schedule a new audit and complete the process before its expiration.
